DISTANCE SALES AGREEMENT
ARTICLE 1 – PARTIES
This Agreement is executed electronically, in accordance with the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, between the BUYER and the SELLER whose details are provided below.

BUYER:
ARTICLE 2 – SUBJECT OF THE AGREEMENT
The subject of this Agreement is to determine the rights and obligations of the Parties regarding the sale and delivery of the product(s), the qualifications and sales price of which are stated below, that the BUYER has ordered electronically through the website www.giveway.com.tr, in accordance with the provisions of Law No. 6502 and the Regulation on Distance Contracts.
ARTICLE 3 – INFORMATION ON THE PRODUCTS
The type, quantity, sales price, and payment details of the product(s) ordered by the BUYER within the scope of this Agreement are as follows:

All product information has been confirmed by the BUYER during the order process and is stored digitally.
ARTICLE 4 – DELIVERY
4.1. The product shall be sent to the delivery address specified by the BUYER during the order, within the legal period of 30 days at the latest.
4.2. In case the BUYER is not present at the address at the time of delivery, the SELLER shall be deemed to have duly fulfilled its obligation.
ARTICLE 5 – RIGHT OF WITHDRAWAL
5.1. The BUYER is entitled to withdraw from this Agreement within 14 (fourteen) days without providing any reason and without incurring any penalty.
5.2. The withdrawal period begins on the day the product is delivered to the BUYER.
5.3. To exercise the right of withdrawal, the BUYER must notify the SELLER in writing within this period.
5.4. In case of withdrawal, the product must be returned with its packaging, content, and invoice.
5.5. The shipping cost of returning the product belongs to the BUYER.
5.6. The SELLER shall refund the product price within 14 days from the date the withdrawal notification is received.
ARTICLE 6 – PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal cannot be exercised in respect of the following products:

Products manufactured upon the BUYER’s special requests or personal needs

Single-use products
-
Products that are at risk of rapid deterioration

Non-returnable hygienic products (underwear, swimsuits, etc.)

Cosmetic products whose packaging has been opened
-
Products whose packaging has been opened after delivery
ARTICLE 7 – PRICE AND PAYMENT
7.1. The product price shall be paid by the BUYER via the chosen payment method.
7.2. By completing the payment, the BUYER shall be deemed to have accepted this Agreement.
ARTICLE 8 – COMPETENT COURT
In disputes arising from the implementation of this Agreement, within the monetary limits announced by the Ministry of Trade of the Republic of Turkey, the Consumer Arbitration Committees and Consumer Courts located in the BUYER’s place of residence shall have jurisdiction.
ARTICLE 9 – ENFORCEMENT
This Agreement enters into force on the date it is electronically approved by the BUYER.
